GuardX – Terms & Conditions

1. Agreement to Terms

These Terms & Conditions ("Terms") constitute a legally‑binding agreement between you (“you” or “the Customer”) and GuardX Ltd ("GuardX", "we", "us" or "our") governing your access to and use of guardx.co.uk and any related mobile applications or digital channels (collectively, the “Site”). By accessing or using the Site you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must stop using the Site immediately.
These Terms incorporate by reference any supplemental terms and policies posted on the Site from time to time. We may revise the Terms at our sole discretion. When we do, we will update the "Last updated" date above. Continued use of the Site after any change constitutes acceptance of the revised Terms.
The information on the Site is intended for UK residents. If you choose to access the Site from outside the United Kingdom you are responsible for compliance with applicable local laws. The Site is intended for users aged 18 and over. If you are under 18 you may only use the Site with the consent and direct supervision of a parent or guardian, who agrees to be bound by these Terms on your behalf.

2. Legal Disclaimer

GuardX is not liable for any dental complications, injuries or damage that may result from use of our products, including self‑administered impression kits or custom‑fit mouthguards. This includes (but is not limited to) loosening, displacement or damage to crowns, bridges, fillings, veneers, orthodontic appliances, implants or other existing dental work. Our products do not constitute medical or dental advice and are not a substitute for professional care. Customers with existing dental restorations, orthodontic treatment or oral‑health concerns should consult a qualified dental professional before taking impressions or using our products. By purchasing or
using GuardX products you acknowledge these risks and accept full responsibility for any
outcomes.

3. Intellectual Property Rights

Unless otherwise stated, the Site and all content and materials on it – including but not limited to code, databases, text, photographs, graphics, audio, video, design and logos (collectively, “Content”) – are owned by or licensed to GuardX and are protected by UK and international copyright, trademark and other intellectual‑property laws. Subject to your compliance with these Terms, GuardX grants you a limited, non‑exclusive, non‑transferable licence to access the Site and to download or print portions of the Content for your personal, non‑commercial use only. All rights not expressly granted herein are reserved.

4. User Representations
By using the Site you warrant that:
1. any information you provide is true, accurate and current;
2. you have authority to enter into these Terms;
3. you are at least 18 years old (or have parental consent);
4. you will not access the Site by automated means;
5. your use of the Site will comply with applicable laws and these Terms.

We may suspend or terminate your account if you provide inaccurate information or breach these Terms.

5. User Registration & Account Security

You may be required to create an account. You are responsible for maintaining the
confidentiality of your login details and for all activities under your account.

6. Products

We endeavour to display product colours, features and specifications accurately, but cannot guarantee your device’s display reflects actual colours. All products are subject to availability and may be withdrawn at any time. Prices may change without notice.

7. Purchases & Payment

We accept Visa, Mastercard, American Express and PayPal. All prices are in Pounds Sterling
(GBP) and include VAT where applicable. You agree to provide accurate payment information and authorise us to debit your chosen payment method for the total payable. We reserve the right to cancel or limit any order.

8. Delivery & Risk

Delivery charges and timescales are shown at checkout. Risk in the products passes to you
when they are delivered.

9. Returns & Refunds

Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts
(Information, Cancellation and Additional Charges) Regulations 2013 are unaffected. • You
have 14 days from receipt of goods to cancel a distance contract and 14 further days to return them, unless the goods are made to your specifications or clearly personalised (such as custom‑fit mouthguards), in which case the right to cancel does not apply. • If a product is faulty or not as described, you are entitled to a repair, replacement or refund in accordance with UK consumer law. 10. Prohibited Activities

You may not:
1. use the Site for any unlawful purpose;
2. collect data or content from the Site without permission;
3. upload viruses or malicious code;
4. interfere with Site security or operation;
5. infringe any intellectual‑property right; or
6. behave in a harassing, abusive or deceptive manner.
11. User Generated Content
If you submit reviews, images or other content ("Contributions") you grant GuardX a perpetual, royalty‑free licence to use, reproduce and display those Contributions. You must have all necessary rights in any Contribution and it must not be defamatory, obscene or unlawful. We may remove any Contribution at our discretion.

12. Privacy & Data Protection

We process personal data in accordance with the UK General Data Protection Regulation
(GDPR) and the Data Protection Act 2018. Please review our Privacy Policy for details of
how we collect, use and protect your data.

13. Modifications & Interruptions

We may modify or discontinue the Site (or any part of it) at any time without notice. We are not liable for any disruption or loss you may suffer as a result.

14. Disclaimer 

The Site and products are provided “as is” and “as available”. To the fullest extent permitted by law, GuardX disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non‑infringement. We do not guarantee that the Site will be secure or error‑free.

15. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or any liability that cannot legally be limited. Subject to the foregoing, GuardX will not be liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill. Our aggregate liability to you for any claim shall not exceed the amount you paid to us for the product or service to which the claim relates.

16. Indemnity

You agree to indemnify and hold GuardX harmless from any claim, loss or damage arising out of your breach of these Terms or your misuse of the Site.

17. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. The courts of England & Wales
have exclusive jurisdiction over any dispute arising under or in connection with these Terms, unless you are a consumer resident in another part of the UK, in which case you may bring proceedings in your local courts

18. Complaints & Alternative Dispute Resolution

If you have a complaint, please contact us first at support@guardx.co.uk and we will try to
resolve it. If we cannot resolve the dispute you may refer it to an approved Alternative Dispute Resolution (ADR) provider. Further information is available from the UK Competition & Markets Authority or your local Trading Standards service. Online purchasers may also use the EU ODR platform: https://ec.europa.eu/consumers/odr.

19. Electronic Communications

You consent to receive communications from us electronically and agree that electronic communications satisfy any legal requirement that such communications be in writing.

20. Entire Agreement

These Terms, together with any policies referenced herein, constitute the entire agreement
between you and GuardX in relation to your use of the Site.
